Terms of Service

The 30-second version. Summiva writes you a weekly checklist for long-term goals you set for your child. The plans are useful, but they're suggestions, not professional advice, so please use your own judgment. Subscriptions auto-renew via Apple. Lifetime is final and non-refundable after 14 days. Indian law governs any disputes.
1. The agreement
These Terms are an agreement between you and Anand Yadav (an individual based in India, "we", "our"). When you create a Summiva account, download the app, or buy something through the app, you agree to these Terms and our Privacy Policy.
If you don't agree, please don't use the app. We can't make exceptions for individual users.
2. Eligibility
You must be at least 18 to create a Summiva account. By signing up, you confirm you're 18+ and that you have the right to enter information about any child whose name and details you add, typically because you're their parent or legal guardian. If you're not, please don't use someone else's child's information here.
3. What Summiva does
Summiva is a parent-facing iOS app that:
- Lets you set long-term development goals for children aged 3 to 12 across curated domains (chess, swimming, music, reading, math, public speaking, foreign languages).
- Writes a personalised weekly checklist for each goal, drawing on established curriculum frameworks (FIDE, ABRSM, Swim England, Singapore Math, Toastmasters, CEFR, and similar). The plans are produced by Anthropic's Claude.
- Lets you log progress, rate tasks, and add notes, which then feed into the next week's plan.
4. The plans are suggestions, not professional advice
The weekly checklists are written by a large language model and are informational only. Summiva uses Anthropic's Claude to draft the plans. The model is helpful but it gets things wrong. Plans may include mistakes, outdated references, or activities that don't fit your specific child. Please use your own judgment. Summiva is not a substitute for qualified educators, paediatricians, therapists, sports coaches, music teachers, or other professionals.
To be specific:
- We don't guarantee any particular outcome for your child.
- Summiva is not affiliated with, partnered with, certified by, or endorsed by FIDE, ABRSM, Royal Conservatory of Music, Trinity College London, Suzuki, Swim England, Toastmasters, MetaMetrics (Lexile), the Singapore Ministry of Education, or any other organisation referenced. Their names identify the publicly available curriculum frameworks the plans draw on for educational purposes. There is no endorsement, partnership, certification, or affiliation of any kind.
- If you're not sure whether a suggested activity is safe or appropriate for your child, don't do it. Consult someone qualified instead.
5. Subscriptions and the lifetime offering
Auto-renewing subscriptions (monthly and annual)
- Subscriptions are billed via your Apple ID at the rates shown in the app at the time of purchase.
- They renew automatically at the end of each billing period. To cancel, go to iPhone Settings → Apple ID → Subscriptions at least 24 hours before renewal.
- Subscription refunds are handled by Apple under their standard policy. We can't issue them directly.
Founder's Lifetime
- The Lifetime offering is limited to the first 1,000 buyers globally. Once 1,000 lifetime entitlements are issued, the offering retires permanently.
- The Lifetime entitlement is granted for the lifetime of the Service or your account, whichever is shorter. It's not transferable to other people or other Apple IDs.
- Lifetime purchases are final and non-refundable 14 days after purchase. Within the first 14 days, refunds are available via Apple under their standard policy. After 14 days, no refunds. That's part of the trade-off for one-time pricing on indefinite access.
- If we ever discontinue the Service, lifetime users are not entitled to a partial refund. We commit to at least 90 days' notice before any discontinuation.
Pricing changes
We may change subscription prices for new subscribers at any time. For existing subscribers, we'll give at least 30 days' notice in-app and by email before any price increase, and you'll be able to cancel before the new price takes effect. Lifetime entitlements are never affected by future price changes.
What happens if you cancel
Canceling a subscription, ending a free trial without converting, or letting an annual subscription expire never deletes your data. Your account, all children you added, all goals, all weekly progress and ratings, and your full history remain stored in your account.
When your subscription ends, the app shows you only your first child and that child's first goal, to keep the free experience focused. Everything else is preserved and stays in your account; it is hidden from the app's display until you re-subscribe. Re-subscribing instantly restores access to everything you previously had — nothing to recover, nothing to import.
You can permanently delete your account (and all data) at any time from inside the app: Settings → Delete account. That is the only path that destroys data.
6. Acceptable use
Please don't:
- Use Summiva for anything illegal.
- Add information about other people's children without their parent or legal guardian's consent.
- Reverse-engineer, decompile, or try to extract the app's source code.
- Scrape, mass-download, or automate access to the Service.
- Try to get the AI to produce sexual, violent, hateful, or harmful content. (It's filtered to refuse those requests anyway.)
- Resell or redistribute access to a paid account.
We may suspend or terminate accounts that break these rules.
7. The content you write
You own what you write: your child's first name, your "why" notes, your weekly observations, all of it. By submitting content, you give us a limited, non-exclusive, royalty-free licence to store and process it for the sole purpose of running the Service for you. We don't use your content to train AI models. We don't show your content to other users. We don't sell your content.
8. Intellectual property
The Summiva name, logo, design, and codebase are owned by Anand Yadav. The weekly checklists themselves are produced by a language model and vary every time, so we don't claim them as copyrightable works. Use them however you like for your own family.
9. Closing your account
You can delete your account any time from inside the app (Settings → Delete account) or by emailing hello@summiva.com. We delete your account data within 30 days, subject to the retention rules in the Privacy Policy (mainly: we keep tax-mandated transaction records for 7 years, but those are anonymous lines, not personal data).
We can suspend or terminate your account if you violate these Terms, if we're required to by law, or if continued service to you would expose us to legal risk. If we terminate for breach, no refund is owed.
10. The legal disclaimer (the "as is" part)
Summiva is provided "as is" and "as available", without warranties of any kind, express or implied. We don't promise the Service will be uninterrupted, error-free, or that it will achieve any specific outcome for your child.
To the maximum extent permitted by law, our total aggregate liability to you for any claim related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) ₹10,000.
We're not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if we've been told such damages were possible.
Some jurisdictions don't allow these kinds of exclusions. In those places, our liability is limited to the maximum permitted by local law.
11. Indemnity
You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable lawyer fees) arising from your use of the Service in violation of these Terms or applicable law.
12. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
If you're outside India, your local consumer-protection laws may give you additional rights that override certain provisions here. Those rights aren't affected.
13. When these Terms change
We may update these Terms when we add features, change pricing, or in response to legal changes. The "Last updated" date at the top reflects the most recent change. For material changes that affect your rights, we'll notify you in-app and by email at least 14 days before they take effect. Continued use after that point means you accept the updated Terms.
14. Severability and the whole agreement
If any provision of these Terms is unenforceable, the rest still applies. These Terms, together with the Privacy Policy, are the whole agreement between you and us regarding the Service.
