Terms of Service

Plain-English summary: Summiva gives you AI-generated weekly checklists for long-term goals for your child. The AI is helpful but imperfect — use parental judgment. Subscriptions auto-renew via Apple. Lifetime deal is final and non-refundable. Indian law governs disputes.

1. Agreement

These Terms of Service ("Terms") form a legally binding agreement between you and Anand Yadav (an individual based in India, "we", "our"). By creating a Summiva account, downloading the app, or making a purchase, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service.

You must be at least 18 years old to create a Summiva account. By creating an account you represent that you are 18+, and that you have the authority to enter information about any child whose name and details you add to the Service (typically because you are their parent or legal guardian).

AI output may contain errors, outdated information, or recommendations that are inappropriate for your specific child. Use parental judgment. Summiva is not a substitute for qualified educators, paediatricians, therapists, sports coaches, music teachers, or other professionals.

We may change subscription prices for new subscribers at any time. For existing subscribers, we will give at least 30 days' notice in-app and by email before any price increase, and you will be able to cancel before the new price takes effect. Lifetime entitlements are never affected by future price changes.

7. Your content

You retain ownership of the content you submit (notes, child name, etc.). By submitting content, you grant us a limited, non-exclusive, royalty-free licence to store and process it solely for the purpose of operating the Service for you. We do not use your content to train AI models. We do not show your content to other users. We do not sell your content.

8. Intellectual property

The Summiva name, logo, app design, and codebase are owned by Anand Yadav. AI-generated checklists, while delivered to you through the Service, are inherently variable and not claimed as copyrightable works by us; you may use them however you wish for your own family.

9. Account termination

You may delete your account at any time from inside the app or by emailing anandyadav.bn@hotmail.com. We will delete your account data within 30 days, subject to the retention rules in the Privacy Policy.

We may suspend or terminate your account if you breach these Terms, if we are required to do so by law, or if continued provision of the Service to you would expose us to legal risk. If we terminate your account for breach, no refund is owed.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will achieve any specific outcome for your child.

To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) ₹10,000.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for certain damages — in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable lawyers' fees) arising from your use of the Service in violation of these Terms or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

For users outside India, your local consumer-protection laws may give you additional rights that override certain provisions of these Terms — those rights are not affected.

13. Changes to these Terms

We may update these Terms when we add features, change pricing, or in response to legal changes. The "Last updated" date at the top reflects the most recent change. For material changes that affect your rights, we will notify you in-app and by email at least 14 days before the change takes effect. Your continued use of the Service after that point constitutes acceptance of the updated Terms.

14. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
